摘要:

被遗忘权是针对个人数据保护的新兴法律概念。以四要素分析法、立法分析法、国际比较分析法分析被遗忘权，有助于剖析数字档案用户行使被遗忘权的理论依据和实践可能。与此同时，数字档案用户行使被遗忘权仍具有理论困境和实践困局，受到档案机构、档案用户和社会公众的多方位制约。平衡理论的社会学发展规律能够用于分析数字档案用户行使被遗忘权的可能状态和发展趋向。只有档案机构、档案用户、社会公众相互信任并支持协调，才能构建并维持强平衡状态网络关系的稳定，保障数字档案用户被遗忘权的长期并可持续行使。

Abstract：

The right to be forgotten is an emerging legal concept aimed at protecting personal data. By employing the four-element analysis method, legislative analysis, and international comparative analysis, this study explores the theoretical foundations and practical implications for digital archival users to exercise their right to be forgotten. At the same time, the exercise of the right to be forgotten by digital archive users still faces theoretical and practical difficulties, which are subject to multiple constraints from archive institutions, archive users, and the general public. The sociological development laws of balance theory can be used to analyze the possible states and development trends of digital archive users' exercise of the right to be forgotten. Only through mutual trust and coordinated support among archival institutions, archival users, and the public can a robust and balanced network relationship be established and maintained, thereby ensuring the long-term and sustainable exercise of the right to be forgotten by digital archival users.
