利益相关者视域下档案众包数据的著作权利益关系网络识别及完善路径

摘要: 

在数据资产化理念普及和数据要素价值释放的背景下，档案数据在使用过程中面临著作权风险。相比其他网络资源，档案众包数据因其开放平台生产特征和多方主体参与特性，权属问题更为复杂。本研究立足档案众包数据特性，从众包环节出发，分析档案众包数据著作权的潜在风险，通过应用利益相关者理论，系统梳理档案众包过程中涉及的著作权利益相关者，结合案例构建著作权利益相关者关系网络，揭示主要利益相关者的利益诉求及关系网络的不足，从法律法规、平台管理、经济利益三重视角提出完善路径，以期助力发挥档案众包数据的社会效益，促进档案众包模式的稳健发展。

Abstract：

In the context of the popularization of data assetization and the release of value of data elements, archival data faces copyright risks during its use. Compared to other online resources, archival crowdsourced data, due to its open platform production and multi-party participation characteristics, encounters more complex ownership issues. This study analyzes the potential copyright risks in archival crowdsourced data, focusing on the crowdsourcing process. Using stakeholder theory, the copyright stakeholders involved in the crowdsourcing process are systematically identified, the relationship network of copyright stakeholders is constructed by combining the cases, the interests of the main stakeholders and the inadequacy of the relationship network are revealed, and the path of improvement is proposed from the triple perspectives of laws and regulations, platform management, and economic interests, aiming to enhance the social benefits of the archival crowdsourced data, and promote the steady and healthy development of the crowdsourcing model.
