TDM版权多主体利益冲突及协调博弈研究

摘要:

【目的/意义】文本与数据挖掘技术在促进知识共享和文化传播的同时,也引发了新的版权利益冲突,而法
律的滞后和复杂的修改环境又增加了衡平各方利益的难度。有鉴于此,各利益方可参与博弈协调预期、定纷止
争。【方法/过程】文章从文本与数据挖掘技术造成的版权问题所涉及的利益博弈主体入手,对图书馆、数字出版商
和版权人在文本与数据挖掘技术版权问题中的策略选择进行分析,构建三方博弈模型。【结果/结论】结合演化博弈
方法分析各方在现有制度和文化环境下可能做出的最优策略选择,以为文本与数据挖掘技术版权的多主体合作提
供一种参考或者协同路径。【创新/局限】文章试图通过构建博弈模型从图书馆、数字出版商和版权人三方博弈的角
度研究TDM版权问题,后续可考虑加入更多衡量指标。

Abstract:

【Purpose/significance】Text and data mining technology promotes knowledge sharing and cultural dissemination, but it also
leads to contradictions and new copyright conflicts at the same time. The lag of law and the complex amendment environment also
make it more difficult to balance the interests of all parties. For this reason, all stakeholders can participate in the game which can co⁃
ordinate expectations and settle disputes.【Method/process】Therefore, starting with the stakeholders involved in the copyright issues
caused by text and data mining technology, this paper analyses the strategy choices of libraries, digital publishers and copyright own⁃
ers in the copyright issues of text and data mining technology and constructs a tripartite game model.【Result/conclusion】The evolu⁃
tionary game theory is used to analyze the optimal strategy choices that each party may make under the existing system and cultural en⁃
vironment, so as to provide a reference or collaborative path for the multi-agent cooperation of text and data mining technology copy⁃
right.【Innovation/limitation】This paper attempts to build a game model to study the TDM copyright issue from the perspective of the
tripartite game among libraries, digital publishers and copyright owners. We can consider adding more measures in the future.
