基于三方演化博弈的APP个人信息安全监管研究

摘要: 【目的/意义】为完善 APP个人信息安全监管,有必要研究 APP个人信息安全监管中的三方主体演化博弈 问题。【方法/过程】基于演化博弈理论,构建 APP用户、APP从业者、政府监管部门三方演化博弈模型,分析演化博 弈系统的均衡稳定策略,并仿真分析稳定策略的演化过程。【结果/结论】研究表明,(消极维权,自律,低成本监管)、 (消极维权,不自律,高成本监管)与(消极维权,自律,高成本监管)是演化博弈系统的三种稳定策略,据此提出加大 APP 个人信息安全宣传与教育力度,激发 APP 用户的维权意识;明确 APP 从业者自律义务,建立行业内部监管机 制;完善以激励与约束为主体的激励性监管手段等建议,以期实现 APP 个人信息安全监管效益最大化。【创新/局 限】未来将选择科学的方法和技术对 APP个人信息安全监管的三方博弈模型参数进行敏感性分析,从而优化模型 的稳健性和可靠性。

Abstract: 【Purpose/significance】In order to improve the regulation of APP personal information security, it is necessary to study the problems of tripartite evolutionary game in the regulation of APP personal information security【. Method/process】Based on the evolu⁃ tionary game theory, we construct a tripartite evolutionary game model of APP users, APP practitioners and government regulators. To analyze the equilibrium stabilization strategy of the evolving game system and simulate the evolution process of the stabilization strat⁃ egy.【Result/conclusion】The research shows that (negative rights protection, self-regulation, low-cost regulation), (negative rights pro⁃ tection, no self-regulation, high-cost regulation) and (negative rights protection, self-regulation, high-cost regulation) are the three stable strategies of the evolving game system. Accordingly, this paper proposes the following countermeasures: Increase the publicity and education on APP personal information security to stimulate APP users' awareness of their rights; Clarify the self-regulatory obli⁃ gations of APP practitioners and establish an internal regulatory mechanism for the industry; Improve the incentive-based regulatory instruments mainly based on incentives and constraints. Ultimately, the goal of maximizing the benefits of APP personal information se⁃ curity regulation will be achieved【. Innovation/limitation】In the future, scientific methods and technologies will be selected to conduct sensitivity analysis on parameters of the three-party game model of APP personal information security supervision, so as to optimize the robustness and reliability of the model.
