摘要: 《中华人民共和国档案法》域外适用问题的探讨与实施对于完善我国域外法律体系建设、维护我国国家利益以及推动我国档案法制现代化具有重要意义。本文根据法律域外适用的属地原则、属人原则以及保护性原则界定了《档案法》域外适用的规制对象,指明了当前我国《档案法》域外适用还存在法理束缚、缺乏先例借鉴、涉外法律人才短缺等困境,并建议增设有关域外效力的法律条款,以期促成《档案法》域外适用效力的真正实现。

Abstract：The discussion and implementation of the extraterritorial application of the archives law of the People's Republic of China is of great significance to improve the construction of the extraterritorial legal system of our country, safeguard our national interests and promote the modernization of the archives legal system of our country. According to the territorial principle, personal principle and protective principle of the extraterritorial application of law, this paper defines the regulatory objects of the extraterritorial application of the archives law, points out that the current extraterritorial application of the archives law in China is still in the dilemma of legal binding, lack of precedent and reference, and shortage of foreign legal talents, and proposes to add legal provisions related to extraterritorial effect in order to promote the extraterritorial application of the archives law the real realization of application effect.
