摘要:

行政机关内部执法程序事关“内部人员”的权利保障,是实现社会正义的重要组成部分,其公平性通过司法化才能得到制度性的保障,这对以对内管理为主的档案行政机关尤为重要。档案行政执法司法化不只是档案行政机关内部执法程序设置的科学、裁决组织和听诉程序的合理,还包括其裁决结果应接受国家司法机关的司法审查。

Abstract:

Administrative internal law-enforcing procedures relating to internal personnel’s rights is an important part of the societal justice. Its fairness should be guaranteed by the judicial system. This is especially important to the archival administration department because of its majority internal management. Judicialization is not only the scientific design of the procedures of administrative internal execution, but also the reasonableness of the verdict organization and the hearing procedure, and the verdict itself should be reviewed by the judicial authority as well.
