摘要：

文章针对在档案提供利用工作中律师行使调查取证权所遇到的困境,从社会认识误区、部门利益影响和法律法规的不当规定等角度分析了律师查询利用档案资料陷入困境的成因,提出了通过加强法规建设、“三个体系”建设和社会建设等来保障律师的调查取证权的对策。

Abstract:

This article focuses on the difficulties when lawyers exercise the right of investigate and obtain evidence in access to archives, and analyzes causes mainly from aspects of social cognition, department interests, improper provisions of laws and regulations. Moreover,it suggests that strengthen legal construction, “three systems” construction,and social construction could ensure lawyers’ right of investigate and obtain evidence.
