摘要:

弱势群体对政府信息的有效获取是解决其信息贫困问题的关键。而确保弱势群体有效获取政府信息,就需要保障弱势群体信息获取权的实现。这又必然涉及相关主体的利益关系,引发公权与私权之间、公权与公权之间的冲突,为此需要构建相应的平衡机制。平衡公权与私权冲突的机制是:实行弱势群体整体利益公共化原则;实行政府信息公开推定原则;确保弱势群体信息获取权获得救济原则。平衡公权与公权之间的冲突,首先且始终需要从平衡公权主体所代表的根本利益着手,然后通过法律规范将这种利益、权力及其相互关系表达和体现出来。

Abstract:

In the information society, That effectively acquire government information by the vulnerable group is the key to sovle the problem of information poor. To smooth out this negative impact, the right of access to government information held by the vulnerable group must be guaranteed. However, this must involve profits relationship of relating stakeholders and will lead to conflicts of various rights, there are conflicts between public rights and private rights and conflicts between public rights and public rights. Therefore, a corresponding balance mechanism need to establish. In order to balance conflicts betwwen public rights and private rights, the mechanism need to carry out the principle of overall interests publicity of the vulnerable group, the principle of government infomation disclosure presumption, and the principle of ensuring the information access right of the vulnerable group that could get relief. While in order to balance conflicts between public rights and public rights, fisrt, the mechanism must start from balancing fundamental interests that power subjects represented all along, and then make this kind of interests, rights and interrelations expressed and reflected through legal norm.

[1] 需要注意的是,不应将弱势群体的信息获取权与知情权混为一谈.二者既有区别,又有联系.从区别上看,弱势群体的知情权主要解决弱势群体对信息的认知问题,强调的是作为信息主体主观上的权利,而弱势群体的信息获取权则主要解决弱势群体获取信息的过程与结果(含方式)问题,强调的是信息主体客观上的权利.从联系上看,一方面,信息获取权以知情权为基础.因为只有享有了“知的权利(right to know)”,才能有信息的获取.另一方面,信息获取权是知情权的实现途径.信息获取主体对信息的“知悉”、“了解”,即实现其知情权,要以对信息的获取为条件.
[2] 作者于2011年1-3月对四川省残疾人、农民工、下岗工人、空巢老人和少年儿童等弱势群体进行调查.共发放调查问卷1095份,回收有效问卷911份.除另有说明外,本文所说的作者调查都是指该调查.
