摘要：

论文对政府信息公开和档案公开的联系与区别进行了详细的分析,其中,两者的联系有：客体具有同源性;公开的目的相同;具有相同的服务对象;在实践上存在衔接与互动。两者的区别有：客体存在差异性;公开时间规定不同;公开的法制理念不同;公开的执行主体不同;公开的救济不同。

Abstract:

This article detailed analyzes the connections and differences between the government information disclosure and archives open. The connections between them including following aspects: the homology of objects, the same purpose, the same service objects and exists combination and interactivity in practice. The differences between them including following aspects: the object of diverseness, different provision of open time, different open conception of legality, different open executive agent and open relief.

[5]	虽然《国务院办公厅关于施行〈中华人民共和国政府信息公开条例〉若干问题的意见》规定,行政机关对申请人申请公开与本人生产、生活、科研等特殊需要无关的政府信息,可以不予提供.但这一规定实际很难实施,申请人仅声称为了学术研究就可以规避这一限制,就如同本文为了研究政府信息公开就可以申请政府信息公开一样.因为宪法也规定,公民有进行科学研究、文学艺术创作和其他文化活动的自由.国务院办公厅《关于做好政府信息依申请公开工作的意见》(国办发〔2010〕5号)要求妥善处理研究课题类申请,也只是要求“一事一申请”.
