The legislative idea and the aim location of the second round amendment of Archives Law is significantly deferent from the first round amendment. The emphasis of the amendment should center around the following issues: transplanting the legislative spirit of “openness is the principle and confidentiality is the exception” established by the Regulation on the Disclosure of Government Information; how to write in the electronic records to the law; how to ensure the effective development of archives administrative law enforcement in terms of legislative technology; etc. The report also proposes that the successful foreign experiences be used and the legislative models according with the situation of our country be selected.
