摘要:

新修订的《中华人民共和国档案法》坚决贯彻总体国家安全观,深入探讨其安全理念具有重要的理论与现实意义。通过分析法律内容,识别条文中规定的安全形态,析出具体的安全制度,发现新《档案法》安全理念的具体特征体现为以人为本的目标导向、协同合作的治理方式、理性辩证的保护手段和统筹兼顾的开放态度。同时,本文以总体国家安全观为标尺,认为新《档案法》及其配套法规规章应在档案数据安全与跨国企业境外档案安全两方面进行完善。

Abstract：

The newly revised Archives Law of the People's Republic of China (Archives Law) resolutely implements the holistic view of national security, and it is of great theoretical and practical significance to deeply explore its security concept. By analyzing the content of the law, identifying the security forms specified in the provisions, and separating out specific security systems, it can be found that the specific features of the security concepts of the Archives Law are people-oriented goal orientation, cooperative governance, rational and dialectical protection means and balanced attitude of archives opening. At the same time, taking the holistic view of national security as a yardstick, it is believed that the new Archives Law and its supporting regulations should be improved in two aspects: archive data security and overseas archives security of multinational enterprises.
